Terms of Service

1. Acceptance of Terms

By accessing or using MonitorGiant ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including free-tier users, paid subscribers, and organisation administrators.

2. Description of Service

MonitorGiant is a hosted SaaS uptime and availability monitoring platform. The Service provides HTTP, keyword, SSL, DNS, TCP, and sitemap monitors, along with alerting, notification channels, and reporting tools. Features available to you depend on your active subscription plan.

3. Account Registration

To use the Service you must register for an account. You agree to:

  • Provide accurate, current, and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised access to your account
  • Accept responsibility for all activity that occurs under your account

You must be at least 18 years old to create an account. Accounts may not be shared or transferred without prior written consent.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You must not:

  • Monitor systems or URLs you do not own or have explicit permission to monitor
  • Use the Service to conduct denial-of-service attacks or stress-test third-party infrastructure without authorisation
  • Attempt to reverse-engineer, decompile, or extract the source code of the platform
  • Resell or sublicense access to the Service without a written reseller agreement
  • Use the Service in any way that violates applicable local, national, or international laws

We reserve the right to suspend or terminate accounts that violate these acceptable use requirements without prior notice.

5. Billing and Payments

MonitorGiant operates on a pay-per-feature model. You are charged only for the features and monitor types you activate — there are no mandatory bundles. By activating a paid feature you authorise us to charge your payment method on a recurring basis at the applicable rate.

  • Billing is monthly in advance unless otherwise stated on your plan
  • All prices are listed in USD and exclude applicable taxes
  • You are responsible for all taxes, levies, or duties imposed by your jurisdiction
  • Failed payments may result in temporary suspension of paid features
  • We reserve the right to change pricing with 30 days prior notice via email

6. Cancellation and Refunds

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; you retain access to paid features until that date. We do not provide prorated refunds for partial billing periods. If you believe you have been charged in error, contact us within 30 days of the charge and we will investigate.

7. Intellectual Property

MonitorGiant and all associated trademarks, logos, software, and content are the exclusive property of MonitorGiant and its licensors. These Terms do not grant you any right, title, or interest in the Service beyond the limited licence to use it in accordance with these Terms. You retain all rights to the monitor configurations and data you create within your account.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service you consent to the collection and use of your data as described in the Privacy Policy.

9. Service Availability and SLA

We aim to provide a reliable, high-availability service but do not guarantee uninterrupted access. Planned maintenance will be communicated in advance where possible. MonitorGiant shall not be liable for any losses arising from service downtime, delayed alerts, or missed check results caused by infrastructure events outside our reasonable control.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, secure, or continuously available.

11. Limitation of Liability

To the maximum extent permitted by applicable law, MonitorGiant and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service. Our total aggregate liability to you for any claim arising under these Terms shall not exceed the amount you paid to MonitorGiant in the three months preceding the claim.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, for material changes, notify you by email or via an in-app notice. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where MonitorGiant is registered, unless otherwise required by mandatory local consumer protection law in your country of residence.
